Terms of Service

1. Acceptance of Terms

By accessing or using GetGMV, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access the service.

2. Description of Service

GetGMV is an AI-powered video creation tool designed for social commerce affiliates and creators. The service helps you create short-form videos with AI-generated scripts, voiceovers, and branded overlays for distribution on platforms including TikTok Shop, Instagram Shop, Trybe, and other social commerce platforms as supported.

3. User Accounts

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account and password
• You must be at least 13 years old to use this service
• One person may not maintain more than one free account
• You are responsible for all activity that occurs under your account

4. Subscription Plans and Billing

GetGMV offers paid subscription plans. Specific pricing and feature inclusions are described in the app at purchase.

Auto-Renewal Terms

• Payment is charged to your Apple ID account at the confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the cost of the chosen package
• You can manage and cancel subscriptions in your Apple ID account settings after purchase
• No cancellation of the current subscription is allowed during an active subscription period
• Any unused portion of a free trial period is forfeited when you purchase a subscription

Refunds and Cancellation

Refunds for subscriptions purchased through the Apple App Store are handled by Apple per their refund policy. Request refunds at reportaproblem.apple.com. You can cancel anytime through your Apple ID account settings; cancellation takes effect at the end of your current billing period.

5. Usage Limits

Each subscription tier includes specific usage allowances (videos per day, videos per month) stated in the app. These limits are enforced programmatically. We may temporarily throttle service for accounts exhibiting unusual usage patterns to protect service quality for all users.

6. User Content

• You retain ownership of all video content you create using GetGMV
• By using the service, you grant GetGMV a limited, worldwide, royalty-free license to host, process, and display your content solely to provide the service
• You are solely responsible for ensuring your content complies with the community guidelines and terms of service of every platform where you publish it (TikTok, Instagram, Trybe, etc.)
• You may not use GetGMV to create content that is illegal, harmful, deceptive, or violates third-party rights

7. Acceptable Use

You agree NOT to:

• Use the service for any unlawful purpose
• Upload content that infringes intellectual property rights
• Generate content intended to deceive, defraud, or harm
• Attempt to reverse engineer, hack, or circumvent the service
• Resell or redistribute access to the service without written permission
• Use the service to generate content that violates the policies of any platform you publish to
• Attempt to bypass usage limits via multiple accounts or automated tools
• Use the service to create content for products or claims you have not personally verified
• Use the service to create misleading health, financial, income, or earnings claims
• Use the service for products that violate any platform's prohibited goods policies (weapons, drugs, counterfeit goods, regulated substances, etc.)
• Publish content without making any disclosures required by law or platform policy, including FTC affiliate/sponsored content disclosures on US-distributed content

8. AI-Generated Content

• Scripts, voiceovers, and visual content are generated by AI and may contain errors, inaccuracies, or unintended content
• You are solely responsible for reviewing all AI-generated content before publishing
• GetGMV makes no guarantees about the accuracy, performance, conversion rate, or earnings potential of generated content
• You are responsible for ensuring any required disclosures about AI-generated content on platforms where you publish (TikTok, Instagram, and others increasingly require AI disclosure under certain conditions)
• You acknowledge that AI-generated content carries inherent risks of inaccuracy, unintended phrasing, policy violations, copyright issues, or factual errors
• Each social platform (TikTok, Instagram, Trybe, and others) maintains independent content policies that evolve over time
• GetGMV cannot guarantee that AI-generated content will comply with any specific platform's policies at any given moment
• You agree that you review every piece of AI-generated content before publishing and bear full responsibility for the consequences of publication, including but not limited to: content takedowns, account warnings, account suspensions, account bans, affiliate program removal, monetization revocation, and shadow bans
• GetGMV is not liable for any actions taken against your accounts on third-party platforms as a result of content created with our service

9. No Earnings or Performance Guarantees

GetGMV is a video creation tool. We make no representations or warranties about:

• The amount of money, revenue, GMV (Gross Merchandise Volume), commissions, affiliate earnings, follower growth, video views, engagement rates, conversion rates, or sales you will achieve using our service
• The performance of any individual video created with our service
• Your eligibility, standing, or earnings in any third-party affiliate program (TikTok Shop Affiliate Program, Instagram Shop, Trybe, or others)
• The continued availability of any third-party platform's affiliate program, monetization features, or policies

The name "GetGMV" refers to our brand identity and does NOT constitute a promise, guarantee, or representation that using our service will generate any specific Gross Merchandise Volume, sales, commissions, or income.

Income examples, testimonials, case studies, or success stories shown anywhere in our service, marketing, or communications are not typical results and do not guarantee similar outcomes for any user. Earnings depend on many factors outside our control, including your content strategy, product selection, platform algorithms, market conditions, audience engagement, and individual effort.

You should not subscribe to GetGMV with the expectation of any specific financial return. The service is a tool; the results depend entirely on you.

10. Social Platform Integrations

GetGMV integrates with third-party platforms to publish content on your behalf when authorized:

• TikTok: GetGMV is not affiliated with or endorsed by TikTok. Your TikTok account, content, and standing are governed by TikTok's terms.
• Instagram, Trybe, and other platforms (as supported): same applies — GetGMV is independent from these platforms.

You are responsible for:

• Ensuring your published content complies with each platform's terms and community guidelines
• Maintaining your account standing on each platform
• Any disputes regarding platform-specific policies, monetization, or program eligibility

11. Affiliate Program Disclosure

GetGMV is a tool that helps you create videos for social commerce affiliate programs (TikTok Shop Affiliate Program, Instagram Shop affiliates, and others as platforms emerge). We do not operate any affiliate program, set commission rates, or process commission payments. Your relationship with each platform's affiliate program is solely between you and that platform.

12. Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms, with or without prior notice. Upon termination, your right to use the service ceases immediately.

13. Limitation of Liability

To the maximum extent permitted by law:

• GetGMV is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted service
• GetGMV makes no warranty that the service will meet your requirements, be error-free, or operate without interruption
• GetGMV makes no warranty about results obtained from using the service, including but not limited to earnings, sales, views, followers, engagement, or affiliate commissions
• GetGMV shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: lost profits, lost revenue, lost earnings, lost commissions, loss of business, loss of data, loss of goodwill, service interruptions, or damages resulting from third-party platform actions (account bans, suspensions, content takedowns, affiliate program removal)
• Our total cumulative liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater
• These limitations apply even if we have been advised of the possibility of such damages
• Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for certain damages, so some of these limitations may not apply to you

14. Indemnification

You agree to indemnify, defend, and hold harmless GetGMV and Camden Wilson from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your generated content and how you use it
• Your activity on third-party platforms using content created with GetGMV
• Any account suspension, ban, warning, takedown, loss of monetization, or removal from affiliate programs you experience on TikTok, Instagram, Trybe, or any other platform as a result of content created with our service
• Any claims by third parties (including platforms, brands featured in your videos, or other users) related to content you publish that was created with our service
• Any tax obligations arising from your earnings on third-party platforms — we do not provide tax advice or reporting

15. Copyright Infringement (DMCA)

If you believe content available through GetGMV infringes your copyright, send a DMCA notification to hello@getgmv.com including:

1. Identification of the copyrighted work
2. Identification of the allegedly infringing material
3. Your contact information
4. A good-faith statement that the use is not authorized
5. A statement under penalty of perjury that the information is accurate
6. Your physical or electronic signature

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act.

16. Assumption of Risk

By using GetGMV, you acknowledge and accept:

• Creating and publishing content on social commerce platforms carries inherent business risks
• Platform policies, algorithms, and monetization rules change without notice and are outside our control
• AI-generated content may contain errors or content that violates evolving platform policies
• You are solely responsible for the business decisions you make based on content created with our service
• You assume all risk associated with your use of the service and the consequences of publishing AI-assisted content

17. Apple iOS-Specific Terms

The following terms apply when you obtain GetGMV from the Apple App Store:

• This agreement is solely between you and GetGMV. Apple Inc. is not a party to this agreement.
• Apple has no responsibility for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• Apple is not responsible for product warranties, whether express or implied.
• Apple is not responsible for addressing any claims relating to the app, including product liability, consumer protection, or regulatory compliance claims.
• Apple is not responsible for third-party intellectual property infringement claims relating to the app.
• You represent that you are not located in any country subject to a U.S. Government embargo or designated as "terrorist supporting," and are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them.
• Your use of the app must comply with Apple's App Store Terms of Service and Usage Rules.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict of laws principles.

Disputes arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration in Yellowstone County, Montana, in accordance with the rules of the American Arbitration Association.

You waive any right to participate in class action lawsuits or class-wide arbitration. Either party may seek injunctive relief in court for intellectual property or confidentiality violations.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated Terms. The "Last updated" date at the top reflects the most recent revision.

20. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and GetGMV.
• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute waiver of that right.
• Assignment: You may not assign these Terms without our written consent. We may assign freely.
• Force Majeure: We are not liable for failure to perform due to events beyond our reasonable control, including natural disasters, government actions, or service provider outages.
• Notices: We provide notices via the email associated with your account or through in-app notifications. You consent to receive notices electronically.
• Survival: Provisions that by their nature should survive termination (ownership, indemnification, liability limitations, governing law) shall survive.
